Welcome to SparkWriter. These Terms of Service ("Terms") govern your access to and use of SparkWriter's AI-powered document editing platform. By creating an account or using SparkWriter, you agree to be bound by these Terms. If you do not agree, please do not use our service.

1. Description of Service

SparkWriter is a web-based document editing platform that provides rich text editing, AI-powered writing assistance, cloud document storage, and document management features. The service is available in Free and Pro tiers, each with different usage limits and features as described on our Pricing page.

2. Account Registration

• •You must provide accurate and complete registration information.
• •You are responsible for maintaining the security of your account credentials.
• •You must notify us immediately of any unauthorized access to your account.
• •One person or entity may not maintain more than one free account.

3. Acceptable Use

You agree not to use SparkWriter to:

• •Violate any applicable law, regulation, or third-party rights
• •Create, store, or share content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• •Attempt to gain unauthorized access to our systems or other users' accounts
• •Interfere with or disrupt the integrity or performance of the service
• •Reverse-engineer, decompile, or attempt to extract the source code of SparkWriter
• •Use automated systems or bots to access the service beyond normal API usage
• •Circumvent usage limits or attempt to abuse AI features

4. Content Ownership

Your content is yours. You retain all ownership rights to the documents, text, images, and other content you create using SparkWriter. We do not claim any intellectual property rights over your content.

By using SparkWriter, you grant us a limited license to host, store, process, and display your content solely for the purpose of providing the service to you. This license terminates when you delete your content or your account.

5. AI-Generated Content

SparkWriter's AI features generate suggestions, completions, and modifications based on your input. You are responsible for reviewing and accepting AI-generated content before it becomes part of your document. SparkWriter does not guarantee the accuracy, completeness, or appropriateness of AI-generated content.

6. Intellectual Property

SparkWriter, including its logo, design, source code, features, and documentation, is owned by SparkWriter and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the service without our prior written consent.

7. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users in advance of planned downtime.

8. Payment & Subscriptions

The Free tier is available at no cost with usage limits. The Pro tier requires a paid subscription. All payments are processed securely through our payment processor. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are handled on a case-by-case basis.

9. Limitation of Liability

To the maximum extent permitted by law, SparkWriter and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the service. Our total liability for any claim shall not exceed the amount you have paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

SparkWriter is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will meet your specific requirements or that AI-generated content will be error-free.

11. Termination

You may terminate your account at any time from Settings > Account. We may suspend or terminate your account if you violate these Terms or engage in activity that harms the service or other users. Upon termination, your right to access SparkWriter ceases, and we may delete your data after 30 days.

12. Changes to Terms

We may modify these Terms from time to time. We will notify you of material changes via email or a prominent notice in the service. Your continued use of SparkWriter after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Paris, France.
